Justice Ravinder Dudeja said that in cases of abetment to suicide, it is necessary to pay attention to the mental state of such persons, such as emotional or mental weakness.


The court has clarified that motivating a person for crime, joining the conspiracy or deliberately helping someone to do so is like provoking. Only oppression cannot be considered sufficient to provoke. Marriage or family disputes cannot be seen as only quarrels or fighting as a fight.

The judge clarified that there is not always an element of abetment in suicide cases. The court would have to determine whether the behavior of the accused was such that a normal person could be motivated to commit suicide. The court said that the standard of abetment is that a normal person will commit suicide, not someone who is highly sensitive and unstable. The comment was made while granting anticipatory bail to a woman and her son, who are facing allegations of allegedly provoking her husband's suicide. The person died on 30 April last year.

The petitioners presented medical records of the individual, which made it clear that he was suffering from depression. There was also a history of his unusual behavior and suicide tendency. The court focused on the tape of the recorded conversation while giving relief to the petitioners, which was found to be abusing the petitioners.
